Appendix I: Model withdrawal form
In these conditions the following terms have the following meanings
Additional agreement: an agreement whereby the consumer acquires products, digital content and / or services in connection with a distance contract and these goods, digital content and / or services are provided by the entrepreneur or by a third party on the basis of an agreement between that third party and the entrepreneur;
Reflection period: the period within which the consumer can make use of his right of withdrawal
Consumer: the natural person who does not act for purposes related to his trade, business, craft or professional activity;

Duration agreement: an agreement that extends to the regular delivery of goods, services and / or digital content during a certain period;
Durable medium: any tool - including e-mail - that enables the consumer or entrepreneur to store information that is addressed to him personally in a way that facilitates future consultation or use during a period that is geared to the purpose. for which the information is intended and which allows unaltered reproduction of the stored information;
Right of withdrawal: the possibility for the consumer to cancel the distance contract within the cooling-off period;

Distance contract: an agreement concluded between the entrepreneur and the consumer within the framework of an organised system for distance sales of products, digital content and / or services, whereby exclusive or partial use is made up to and including the conclusion of the agreement. uses one or more remote communication techniques;

These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.
Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, the entrepreneur will indicate, before concluding the distance contract, how the general terms and conditions can be viewed at the entrepreneur and that they will be sent free of charge as soon as possible at the request of the consumer.
If the distance contract is concluded electronically, notwithstanding the previous paragraph and before the distance contract is concluded, the text of these general terms and conditions can be made available to the consumer electronically in such a way that they can be easily stored on a durable data carrier. If this is not reasonably possible, before the distance contract is concluded, it will be indicated where the general terms and conditions can be inspected electronically and that they will be sent free of charge at the request of the consumer electronically or otherwise.
In the event that specific product or service conditions apply in addition to these general terms and conditions, the second and third paragraphs apply and the consumer can always rely on the applicable provision that is most favorable to him in the event of conflicting conditions.
If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.
The offer contains a complete and accurate description of the products, digital content and / or services offered. The description is sufficiently detailed to enable the consumer to make a proper assessment of the offer. If the entrepreneur uses images, these are a true representation of the products, services and / or digital content offered. Obvious mistakes or errors in the offer are not binding for the entrepreneur.
Each offer contains such information that it is clear to the consumer what rights and obligations are attached to accepting the offer.
Subject to the provisions of paragraph 4, the agreement is concluded at the moment the consumer accepts the offer and meets the corresponding conditions.
If the consumer has accepted the offer electronically, the trader will immediately confirm receipt of the acceptance of the offer electronically. As long as the receipt of this acceptance has not been confirmed by the entrepreneur, the consumer can dissolve the agreement.
If the agreement is concluded electronically, the entrepreneur will take appropriate technical and organisational measures to secure the electronic transfer of data and he will ensure a safe web environment. If the consumer can pay electronically, the entrepreneur will take appropriate security measures.
Within the legal frameworks, the entrepreneur can - inform himself whether the consumer can meet his payment obligations, as well as all those facts and factors that are important for a responsible conclusion of the distance contract. If, on the basis of this investigation, the entrepreneur has good reasons not to enter into the agreement, he is entitled to refuse an order or request, with reasons, or to attach special conditions to the implementation.
At the latest upon delivery of the product, service or digital content to the consumer, the entrepreneur will send the following information, in writing or in such a way that it can be stored by the consumer in an accessible manner on a durable medium:
i. the visiting address of the business location of the entrepreneur where the consumer can go with complaints;
ii. the conditions under which and the way in which the consumer can make use of the right of withdrawal, or a clear
statement regarding the exclusion of the right of withdrawal;
iii. information about guarantees and existing service after purchase;
iv. the price, including all taxes on the product, service or digital content; insofar as applicable, the costs of delivery; and the method of payment, delivery or implementation of the distance contract;
v. the requirements for terminating the agreement if the agreement has a duration of more than one year or is indefinite;
vi. if the consumer has a right of withdrawal, the model withdrawal form.
In the event of an extended transaction, the provision in the previous paragraph applies only to the first delivery.
The consumer can dissolve an agreement regarding the purchase of a product during a cooling-off period of at least 14 days without giving reasons. The entrepreneur may ask the consumer about the reason for the withdrawal, but not oblige him to state his reason (s).
The reflection period referred to in paragraph 1 starts on the day after the consumer, or a third party designated in advance by the consumer, who is not the carrier, has received the product, or:
i. if the consumer has ordered several products in the same order: the day on which the consumer, or a third party designated by him, received the last product. The entrepreneur may, provided he has clearly informed the consumer about this prior to the ordering process, refuse an order for several products with different delivery times.
ii. if the delivery of a product consists of several shipments or parts: the day on which the consumer, or a third party designated by him, received the last shipment or the last part;
iii. in the case of contracts for regular delivery of products during a certain period: the day on which the consumer, or a third party designated by him, has received the first product.
For services and digital content that is not supplied on a tangible medium:
The consumer can dissolve a service agreement and an agreement for the supply of digital content that has not been
delivered on a tangible medium for at least 14 days without giving reasons. The entrepreneur may ask the consumer about the reason for the withdrawal, but not oblige him to state his reason (s).
The reflection period referred to in paragraph 3 starts on the day following the conclusion of the agreement.
Extended reflection period for products, services and digital content that has not been delivered on a tangible medium when not informing about the right of withdrawal:
If the entrepreneur has not provided the consumer with the legally required information about the right of withdrawal or the model withdrawal form, the cooling-off period will expire twelve months after the end of the original cooling-off period determined in accordance with the previous paragraphs of this article.
If the entrepreneur has provided the consumer with the information referred to in the previous paragraph within twelve months after the commencement date of the original cooling-off period, the cooling-off period will expire 14 days after the day on which the consumer received that information.
DURING REFLECTION PERIOD
During the reflection period, the consumer will handle the product and the packaging with care. He will only unpack or use the product to the extent necessary to determine the nature, characteristics and operation of the product. The starting point here is that the consumer may only handle and inspect the product as he would be allowed to do in a store.
The consumer is only liable for the depreciation of the product that is the result of a way of handling the product that goes beyond
what is permitted in paragraph 1.
• The consumer is not liable for the depreciation of the product if the entrepreneur has not provided him with all legally required information about the right of withdrawal before or at the conclusion of the agreement.
WITHDRAWAL BY THE CONSUMER AND
If the consumer makes use of his right of withdrawal, he must report this to the entrepreneur within the reflection period by means of the model withdrawal form or in another unambiguous manner.
As soon as possible, but within 14 days from the day following the notification referred to in paragraph 1, the consumer returns the product or hands it over to (an authorised representative of) the entrepreneur. This is not necessary if the entrepreneur has offered to collect the product himself. The consumer will in any case have complied with the return period if he returns the product before the reflection period has expired.
The consumer returns the product with all accessories supplied, if reasonably possible in its original condition and packaging, and in accordance with the reasonable and clear instructions provided by the entrepreneur.
The risk and the burden of proof for the correct and timely exercise of the right of withdrawal lies with the consumer.
The consumer bears the direct costs of returning the product. If the entrepreneur has not reported that the consumer must bear these costs or if the entrepreneur indicates that he will bear the costs himself, the consumer does not have to bear the costs for returning the goods.
If the consumer withdraws after having first explicitly requested that the provision of the service or the supply of gas, water or electricity that have not been made ready for sale in a limited volume or specific quantity commences during the reflection period, the consumer is the entrepreneur an amount due that is proportional to that part of the obligation that has been fulfilled by the entrepreneur at the time of withdrawal, compared to full compliance with the obligation.
• The consumer does not bear any costs for the performance of services or the supply of water, gas or electricity, which have not been made ready for sale in a limited volume or quantity, or for the supply of district heating, if:
i. the entrepreneur has not provided the consumer with the legally required information about the right of withdrawal, the cost reimbursement in the event of withdrawal or the model form for withdrawal, or;
ii. the consumer has not explicitly requested the start of the execution of the service or the supply of gas, water, electricity or district heating during the reflection period.
• The consumer does not bear any costs for the full or partial delivery of digital content not supplied on a tangible medium, if: i. prior to delivery, he has not expressly agreed to commence compliance with the agreement before the end of the reflection period;
ii. he has not acknowledged that he has lost his right of withdrawal when giving his consent; or iii. the entrepreneur has failed to confirm this statement from the consumer.
• If the consumer exercises his right of withdrawal, all additional agreements will be dissolved by operation of law.
If the entrepreneur makes the notification of withdrawal by the consumer electronically possible, he will immediately send a confirmation of receipt after receipt of this notification.
The entrepreneur will reimburse all payments from the consumer, including any delivery costs charged by the entrepreneur for the returned product, without delay but within 14 days following the day on which the consumer notifies him of the withdrawal. Unless the entrepreneur offers to collect the product himself, he may wait with paying back until he has received the product or until the consumer demonstrates that he has returned the product, whichever is the earlier.
The entrepreneur uses the same payment method that the consumer has used for reimbursement, unless the consumer agrees to a different method. The reimbursement is free of charge for the consumer.
If the consumer has opted for a more expensive method of delivery than the cheapest standard delivery, the entrepreneur does not have to repay the additional costs for the more expensive method.
The entrepreneur can exclude the following products and services from the right of withdrawal, but only if the entrepreneur has clearly stated this in the offer, at least in time for the conclusion of the agreement:
Products or services whose price is dependent on fluctuations in the financial market on which the entrepreneur has no influence and which may occur within the withdrawal period;
Agreements concluded during a public auction. A public auction is understood to mean a sales method in which products, digital content and / or services are offered by the entrepreneur to the consumer who is personally present or who is given the opportunity to be personally present at the auction, under the direction of an auctioneer, and where the successful bidder is obliged to purchase the products, digital content and / or services;
Service contracts, after full performance of the service, but only if:
i. the performance has started with the explicit prior consent of the consumer
ii. the consumer has stated that he will lose his right of withdrawal as soon as the entrepreneur has fully performed the agreement
Service agreements for the provision of accommodation, if a specific date or period of execution is provided for in the agreement and other than for residential purposes, goods transport, car rental services and catering;
Agreements with regard to leisure activities, if a specific date or period of execution is provided for in the agreement;
Products manufactured according to specifications of the consumer, which are not prefabricated and which are manufactured on the basis of an individual choice or decision of the consumer, or which are clearly intended for a specific person;
Products that spoil quickly or have a limited shelf life
Sealed products that are not suitable for return for reasons of health protection or hygiene and of which the seal has been broken after delivery;
Products that, by their nature, are irrevocably mixed with other products after delivery;
Alcoholic drinks of which the price was agreed upon at the conclusion of the agreement, but the delivery of which can only take place after 30 days, and the actual value of which depends on fluctuations in the market over which the entrepreneur has no influence;
Sealed audio, video recordings and computer software, the seal of which has been broken after delivery;
Newspapers, magazines or magazines, with the exception of subscriptions to these
The delivery of digital content other than on a tangible medium, but only if:
• the performance has begun with the express prior consent of the consumer; and <
the consumer has stated that he thereby loses his right of withdrawal
During the period of validity stated in the offer, the prices of the products and / or services offered will not be increased, except for price changes as a result of changes in GST rates.
Contrary to the previous paragraph, the entrepreneur can offer products or services whose prices are subject to fluctuations in the financial market and over which the entrepreneur has no influence, at variable prices. This link to fluctuations and the fact that any stated prices are target prices are stated in the offer.
Price increases within 3 months after the conclusion of the agreement are only permitted if they are the result of statutory regulations or provisions.
Price increases from 3 months after the conclusion of the agreement are only permitted if the entrepreneur has stipulated this and:
i. they are the result of statutory regulations or provisions; or
ii. the consumer has the authority to cancel the agreement on the day on which the price increase takes effect.
• The prices stated in the offer of products or services exclude GST.
The entrepreneur guarantees that the products and / or services comply with the agreement, the specifications stated in the offer, the reasonable requirements of reliability and / or usability and the legal provisions existing on the date of the conclusion of the agreement and / or government regulations. If agreed, the entrepreneur also guarantees that the product is suitable for other than normal use.
An additional guarantee provided by the entrepreneur, his supplier, manufacturer or importer never limits the legal rights and claims that the consumer can assert against the entrepreneur on the basis of the agreement if the entrepreneur has failed to fulfil his part of the agreement.
An additional guarantee is understood to mean any obligation of the entrepreneur, his supplier, importer or producer in which he grants the consumer certain rights or claims that go beyond what he is legally obliged to do in case he has failed to fulfil his part of the agreement.
The entrepreneur will take the greatest possible care when receiving and implementing orders for products and when assessing applications for the provision of services.
The place of delivery is the address that the consumer makes known to the entrepreneur.
With due observance of what is stated in article 4 of these general terms and conditions, the entrepreneur will execute accepted orders with due speed, but no later than 30 days, unless another delivery period has been agreed. If the delivery is delayed, or if an order cannot or only partially be executed, the consumer will be notified of this no later than 30 days after placing the order. In that case, the consumer has the right to terminate the agreement without costs and is entitled to any compensation.
After dissolution in accordance with the previous paragraph, the entrepreneur will immediately repay the amount paid by the consumer.
The risk of damage and / or loss of products rests with the entrepreneur until the moment of delivery to the consumer or a pre-designated representative made known to the entrepreneur, unless expressly agreed otherwise.
The consumer can terminate an agreement that has been entered into for an indefinite period and that extends to the regular
delivery of products (including electricity) or services, at any time with due observance of the agreed cancellation rules and a notice period of no more than one month.
The consumer can terminate an agreement that has been entered into for a definite period and which extends to the regular delivery of products (including electricity) or services, at any time by the end of the specified term, with due observance of the agreed cancellation rules and a notice period of at least highest one month.
The consumer can the agreements mentioned in the previous paragraphs:
i. cancel at any time and not be limited to cancellation at a specific time or in a specific period;
ii. at least cancel in the same way as they are entered into by him
iii. always cancel with the same notice period as the entrepreneur has stipulated for himself.
An agreement that has been entered into for a definite period and that extends to the regular delivery of products (including
electricity) or services may not be tacitly renewed or renewed for a fixed period.
Contrary to the previous paragraph, an agreement that has been entered into for a definite period and that extends to the regular delivery of daily news and weekly newspapers and magazines may be tacitly renewed for a fixed period of a maximum of three months, if the consumer opposes this extended agreement. can terminate the end of the extension with a notice period of no more than one month.
An agreement that has been entered into for a definite period and that extends to the regular delivery of products or services may only be tacitly renewed for an indefinite period if the consumer may cancel at any time with a notice period of no more than one month. The notice period is no more than three months in the event that the agreement extends to the regular, but less than once a month, delivery of daily, news and weekly newspapers and magazines.
An agreement with a limited duration for the regular delivery of daily, news and weekly newspapers and magazines (trial or introductory subscription) is not tacitly continued and ends automatically at the end of the trial or introductory period.
• If an agreement has a duration of more than one year, the consumer may cancel the agreement at any time after one year
with a notice period of no more than one month, unless reasonableness and fairness oppose termination before the end of the agreed term.
Unless otherwise stipulated in the agreement or additional conditions, the amounts owed by the consumer must be paid within 14 days after the start of the reflection period, or in the absence of a reflection period, within 14 days after the conclusion of the agreement. In the case of an agreement to provide a service, this period starts on the day after the consumer has received confirmation of the agreement.
When selling products to consumers, the consumer may never be obliged in general terms and conditions to pay more than 50% in advance. If advance payment has been stipulated, the consumer cannot assert any rights whatsoever with regard to the execution of the order or service (s) before the stipulated advance payment has been made.
The consumer has the duty to report inaccuracies in provided or stated payment details to the entrepreneur without delay.
If the consumer does not fulfil his payment obligation (s) on time, after he has been informed by the entrepreneur of the late payment and the entrepreneur has granted the consumer a period of 14 days to still fulfil his payment obligations, after the failure to pay within this 14-day period, the statutory interest is due on the amount due and the entrepreneur is entitled to charge the extrajudicial collection costs incurred by him. These collection costs amount to a maximum of: 15% on outstanding amounts up to AUD 2,500; 10% over the next AUD 2,500 and 5% over the next AUD 5,000 with a minimum of AUD 40. The entrepreneur can deviate from the stated amounts and percentages in favour of the consumer.
The entrepreneur has a well-publicised complaints procedure and handles the complaint in accordance with this complaints procedure.
Complaints about the implementation of the agreement must be submitted fully and clearly described to the entrepreneur within a reasonable time after the consumer has discovered the defects.
Complaints submitted to the entrepreneur will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeable longer processing time, the entrepreneur will reply within 14 days with a confirmation of receipt and an indication when the consumer can expect a more detailed answer.
• Only Australian law applies to agreements between the entrepreneur and the consumer to which these general terms and conditions apply.
Additional provisions or provisions deviating from these general terms and conditions may not be to the detriment of the consumer and must be recorded in writing or in such a way that they can be stored by the consumer in an accessible manner on a durable data carrier.

II Your agreements with Pretty Green
If you order groceries from Pretty Green, the general terms and conditions from Part I apply.
In addition to these conditions, the specific conditions of Pretty Green also apply. We have listed these below in Part II. Together, Part I and Part II form the “general terms and conditions”.
The general terms and conditions apply when you use the Pretty Green app (the “app”) or the website www.prettygreen.com.au (the “website”), and also apply to all information, services and deliveries that we make via the app or providing the website (the “Services”).
We can change the terms and conditions. The changed conditions take effect as soon as they have been adjusted online (at this place) and you place a new order at Pretty Green.
You can download the Pretty Green app for free from Apple's App Store or the Google Play Store. By downloading the app you acquire a non-exclusive, non-transferable and non-sublicensable right to use the app on your phone or tablet. You may not disassemble, decompile, or reverse engineer the app.
Pretty Green's app and services may be modified from time to time. If we ever stop offering our services then your right to use your app will also end.
We do our best to always keep the app up-to-date, but it can sometimes happen that characteristics of products (such as price, appearance and ingredients) are incorrect. In that case, the information on (the packaging of) the product itself or the price that you see in our order and payment confirmation applies. We are not bound by mistakes or errors in our offer. If you no longer want a product - and it is not a fresh product - we will take it back within 14 days without any hassle.
Your Pretty Green account
To use Pretty Green, you need to create a Pretty Green account. That is so easy. Please note that when creating an account you are responsible for ensuring that the information you enter is correct and complete, that the data (only) concerns yourself and that you keep that data up-to-date.
We store your login details securely and will never share them with others. But for the rest you are responsible for keeping your login details confidential. You are also responsible for the use of your Pretty Green account. This means that we are not liable for damage you incur as a result of unauthorised use of your Pretty Green account, unless that damage has been caused by circumstances attributable to us.
To create a Pretty Green account and place orders via the app, you must be 18 years or older. If we deliver products with alcohol, our delivery person can ask for identification when in doubt about your age. This age check is valid up to 25 years.
If you are not 18 or older, our delivery person is unfortunately not allowed to deliver the alcoholic products in your order. If you are not at home - and we have left the groceries at your door or in the garden after consultation - the delivery person will take the alcoholic products back to the local hub. You can pick up the products there, or you can send a message to customer service so that we can find another solution together.
Minimum order amount
The minimum order amount at Pretty Green is $40 AUD, excluding deposit. We do not charge order or delivery costs. Prices, offers and promotions
For our products you always pay the price that the item costs at the time of ordering. You can find that price on the order confirmation. Some fresh products can vary in weight and quantity. The quantity you receive can therefore differ a little from what we mention in the app.
The promotional prices of offers in the app are only valid if the products are (still) on offer when you pay for the order.
Would you like to know more about our weekly promotions, menu promotions, combination promotions or our prices? Then look in the app under the “Account” icon and the heading “Help" or on our website under www.prettygreen.com.au/faq
Some promotions have a limit on the number of products you can order. You will automatically receive a notification in the app as soon as you have added the maximum number of products to your basket.
Except for the Friends discount, all discount codes you receive from us are for personal use. You can only use them once.
You can still share your personal Friends discount code. If a new customer places a first order at Pretty Green and uses your code, you will receive a discount code by e-mail the day after the groceries have been delivered to him or her.
At Pretty Green you pay for groceries in the app, very safe and simple. This can be done via debit card and credit card. Other forms of payment are not possible.
If you want to cancel an order, you can do so up to the day before delivery at 6pm. Unfortunately, it is not yet possible to change a placed order. Before you pay for the order, always check carefully whether you have chosen the right delivery time and whether everything you need is in your shopping cart.
We deliver Monday through Sundays. Have you chosen a delivery time? Then complete your order before 8pm for next day delivery. If you placed your order passed 8pm we will deliver not the next day but the day after.
We will send you a text 15 minutes before we arrive in the 2 hour window you selected in the Pretty green app.
We hope you are at home at the time of delivery. But if you are not there, we will take the groceries back to the local hub. You can then pick them up from us the same evening or the next day. Please contact customer service in advance via email@example.com.
We do our very best to be at your door at the agreed time, but unfortunately we cannot guarantee our delivery times. Fortunately, it almost never happens, but something can always happen along the way. We are therefore not liable for late deliveries.
Have you ordered something, but on second thought you do not want it? Then you can in many cases return the product to us within 14 working days after delivery. More information can be found in Articles 6 to 10 in Part I of these terms and conditions.
Due to the limited shelf life, we unfortunately cannot take back fresh products. Fresh products include: meat, fish, vegetables, fruit, frozen products, dairy and cheese.
Good to know: often there is a better solution than returning, so we recommend that you always contact customer service in advance via firstname.lastname@example.org.
All our daily fresh products have a freshness guarantee. We received the fresh products in the morning and deliver them directly to you the same day.
Of course we do our best to keep the website clean and virus-free, but we cannot guarantee this 100%. PrettyGreen.com.au contains links to websites of third parties and unfortunately we have no influence on the content and functioning of those websites.
Our app, website and services are protected by intellectual property rights. The rights to, for example, logos, software, texts and images lie with Pretty Green and / or the person from whom we have obtained a license. It is not permitted to publish, reproduce and / or edit parts of our app, website or services without our express permission, other than for personal use.
